You see, there's this guy, Gamso. He's apparently against any law that is based on the violation of someone's moral sensibility, like murder, I guess. He thinks a drunk woman breastfeeding a child shouldn't rise to the level of a criminal violation. Well, I wonder, is that really a view that most people hold?

  1. You might at least link to what I wrote (and my blog in general, for that matter) so that people can judge for themselves.

    In any event, and without getting into an argument about details, I think we criminalize a lot of misconduct that we shouldn't criminalize even if it's fair and appropriate to condemn it roundly. But I'm not opposed to criminal law, and if you really think that I believe murder ought not be a crime, you're not paying much attention.

  2. No, I don't believe you think murder should be legal. Just by reading what you write I can tell you aren't a lunatic. I was perhaps being too pithy. I was trying to make the point that all law is based on morality, whether we want to admit it or not. And no, I am not saying that everything immoral should be illegal. You seem to be quite dismissive of the concept of a criminal law based on morality. Why?
